1. Privacy statement

Lodewijk van Thiel | Advocaat ("LvT") values protection of your privacy and the safeguarding of your personal data in accordance with applicable legislation including but not limited to the European General Data Protection Regulation ("GDPR"​). This Privacy Statement addresses how LvT handles and protects your personal data.

2. To whom does this Privacy Statement apply?

This Privacy Statement applies to all persons and all companies and/or organisations for which LvT processes personal data including but not limited to (i) clients of LvT, (ii) potential clients with whom LvT has made contact or wishes to make contact and (iii) all other persons who contact LvT or of whom LvT processes personal data.

3. What are personal data?

Personal data is any information relating to an identified or identifiable (natural) person.

4. What personal data does LvT process?

4.1 LvT processes all personal data that you have provided to LvT about yourself or about third parties and personal data that LvT has derived from other sources such as (business) social media platforms, including the following data:

  • contact details and all other personal data that is necessary for the handling of your case and/or assignment;
  • contact details and other personal data entered into contact forms or other web forms;
  • contact details provided during introductory talks, events, seminars, etc., as stated on business cards; and
  • personal data obtained from other sources such as personal data (i) available on public business social media platforms (such as LinkedIn), (ii) obtained from the Trade Register of the Chamber of Commerce and from the Land Registry and/or (iii) available on other public sources.

4.2 LvT's website may furthermore contain hyperlinks to websites of other parties and social media buttons. LvT is not responsible for the content of those websites or the services of those social media platforms. Furthermore, LvT is not responsible for the privacy policies and the use of cookies on those websites and social media platforms.

5. Cookies

LvT's website (www.lodewijkvanthiel.nl) does not use cookies and does not collect information or data about your visit to its website, your IP-address or your browser.

6. What does LVT use your personal data for?

LvT can use your personal data for various purposes, including the following:

  • the provision and improvement of (legal) services;
  • to comply with legal and regulatory requirements;
  • to maintain contact with clients and third parties; and
  • to invoice provided (legal) services.

7. Why is LvT authorised to proces your personal data?

LvT is authorised to process your personal data on the basis of various legal grounds including one or more of the following:

  • performance of an (i) assignment/instruction provided by you or (ii) agreement;
  • to comply with statutory requirements (such as the obligations to transfer data to the tax authorities);
  • legitimate interest; or
  • your consent which consent maybe evidenced by the fact that you submit a question to LvT by email or otherwise. You are always entitled to withdraw your consent at any time.

8. Sharing of personal data

8.1 Although LvT will in principle not share your personal data with third parties, it may however do so in various situations. These may include but is not limited to:

  • third parties that LvT engages with, such as supervisory authorities and other bodies, in order to comply with statutory obligations;
  • third parties relevant to LvT's legal services, such as counterparties, local counsel, courts, regulatory authorities and governmental institutions; or
  • third party suppliers in connection with the processing of your personal data for solely the purposes described in this Privacy Statement, such as IT providers and communication service providers.

8.2 LvT will only share your personal data with third parties for the purposes of and on the legal grounds stated in this Privacy Statement. LvT shall, if required, take reasonable measures to, if possible, prevent and/or mitigate any negative consequences that may be caused as a result of sharing your personal data with third parties.

8.3 Third parties to whom LvT transfers your personal data are themselves responsible for compliance with privacy legislation. LvT is neither responsible nor liable for the processing of your personal data by these third parties.

9. For how low will your data be kept?

Your personal data is kept in accordance with the applicable legislation. LvT will erase your personal data upon (among other events) expiration of retention periods that apply on the basis of for example statutory requirements.

10. How will your personal data be protected?

LvT wants your personal data to remain as secure as possible. In that respect LVT has taken appropriate technical and organisational measures to protect personal data against loss or any form of unlawful processing including but not limited to the following measures:

  • all personal data is internally only available and accessible in a protected and safeguarded space (such as locked and protected (i) server, (ii) computers and (iii) other portable devises and communication technologies);
  • obligation of confidentiality;
  • paperless services as base principle: use of hard copy documents/paper only insofar strictly necessary; and
  • hard-copy documents will be field in a secure and locked space.

11. Your rights

You are entitled by law to exercise certain rights with regard to your personal data and in this respect you are also entitled to request LvT to:

  • grant you access to your personal data;
  • add, erase, shield or limit your personal data;
  • send a copy of your personal data processed by LvT; and
  • revoke your permission to process your personal data.

11.2 Furthermore you are entitled to (i) raise an objection to the process of your personal data at LvT (contact@lodewijkvanthiel.nl) and/or (ii) file a complaint at the Dutch Data Protection Authority.

12. Amendments

LvT may amend and/or update this Privacy Statement from time to time. Such amendments and/or updates aim to improve LvT's services and the protection of your personal data. You are advised to check this Privacy Statement regularly. You can always view the amended respectively latest version of the applicable Privacy Statement on the website.
